1. Acceptance of Terms

By accessing or using WornWell ("the Service"), operated by WornWell AI from Amsterdam, the Netherlands, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and WornWell AI.

2. Service Description

WornWell is an AI-powered wardrobe intelligence platform that provides digital closet cataloging, cost-per-wear tracking, outfit recommendations, and sustainability insights. The Service uses a combination of on-device and cloud-based analysis technologies to deliver these features.

3. Eligibility

You must be at least 16 years old to use the Service. By registering, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Early Access & Waitlist

WornWell is currently in Early Access (Beta). By joining the waitlist, you acknowledge that:

  • Access to the Service is not guaranteed upon joining the waitlist.
  • Features, pricing, and availability may change at any time during the Beta period.
  • Beta features may contain bugs, errors, or incomplete functionality.
  • Anonymous usage statistics help us prioritize feature development and refine our AI models during the Early Access period.

5. User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Provide accurate and current information when registering.
  • Not share your account with others or create multiple accounts.
  • Notify us immediately of any unauthorized access to your account.
  • Ensure that content you upload (including garment images) does not infringe third-party rights.

6. User Content & Intellectual Property

You retain full ownership of all content you upload, including photographs and closet metadata. By using the Service, you grant WornWell a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing and improving the Service.

All WornWell branding, AI models, algorithms, design, and proprietary technology remain the exclusive property of WornWell AI. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. AI Features & Mirror Mode

Our AI tools, including Mirror Mode, Daily Capsule, Vibe Styling, and Cost-per-Wear analytics, are designed to provide informational suggestions. You acknowledge that:

  • AI recommendations are generated algorithmically and may not always be accurate or suitable.
  • Style advice is subjective and should be used at your own discretion.
  • Cost-per-Wear calculations depend on the accuracy of user-provided data (purchase price, wear frequency).
  • WornWell is not responsible for purchasing decisions made based on AI recommendations.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload content that is obscene, harmful, defamatory, or infringes on others' rights.
  • Attempt to reverse-engineer, decompile, or extract the AI models or algorithms.
  • Use automated scripts, bots, or scrapers to access the Service.
  • Circumvent rate limiting, security measures, or access controls.
  • Resell, redistribute, or commercially exploit the Service without authorization.

9. Subscription & Pricing

Public subscription plans and pricing have not been finalized during private beta. Any future paid plan will be presented with its price, billing period, renewal, cancellation, and applicable refund terms before purchase.

10. Termination

You may delete your account at any time through the app settings. WornWell reserves the right to suspend or terminate accounts that violate these Terms. Upon termination, your personal data will be deleted in accordance with our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by law, WornWell AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms shall be resolved exclusively by the competent courts of Amsterdam, the Netherlands. If you are a consumer in the EU, you retain any mandatory consumer protections under your local law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
